Equinext Terms of Service
The following terms describe the basis on which Equinext allows access to our services and site. Please read this page carefully as use of the site constitutes acceptance of these terms.
General
These Terms and Conditions apply to all services offered by the domain http://www.equinext.co.uk hereafter known as the 'Site'. All Equinext parties are hereafter referred to as 'Equinext', 'we', 'our' or 'us'.
These terms are valid from 1st March 2007 and are effective for all users of the Site.
Equinext is strongly committed to animal welfare and will not tolerate any misuse of this site leading to cruelty to any animal. You are strongly recommended to visit the RSPCA website for specific advice about rehoming horses and ponies. This site also has a good list of horses looking for new homes.
If you believe you have witnessed animal cruelty or are suspicious about any ad or animal offered on this site, please call the RSPCA Cruelty Line on 0870 55 55 999 and let us know so we may act appropriately.
Use of the Site
While using the Site you may not:
- breach any laws or regulations, infringe the copyright, trade mark(s) or any other rights of any third parties or those of the Site;
- post, list or otherwise cause to be displayed any inaccurate, misleading or defamotory content including and not limited to personal information;
- attempt to interfere with the proper operation of the site through malicious or non-malicious intent, including and not limited to altering or preventing the proper display of other users listings, information or posts;
- use the information displayed on the Site to collect data about our users, for any reason whatsoever;
- copy or substantially duplicate the content or appearance of the Site;
If you are using the site for business purposes, such as the sale and purchase of horses or equipment, then you must comply with relevant online trading laws. More information on this can be found here www.businesslink.gov.uk.
Equinext does not presently charge for advertising and has no plans to do so but we retain the right to change this policy at any time, and with effect to any or all users as decided by us.
Liability
Nothing in these terms shall limit or exclude our liability for fraudulent misrepresentation, death or personal injury resulting from negligence on our part, our employees or other agents, or for any other liability that cannot be limited or excluded by law.
Equinext accepts no responsibility for the actions or inactions of our users, nor the veracity of information posted on any advertisment, forum or blog posting.
Equinext offers no guarantees or control over:
- the veracity of any listed item;
- the legality or ability of advertisers to sell or provide any item;
- the legality or ability of any user to purchase or receive any item offered free;
- the quality, legality or worth of any service advertised;
Equinext will not mediate between aggreived parties, nor accept any liability for any failure or disappointment resulting from any transaction related to the site.
Equinext will not accept monies for payment of goods or services related to listed items, nor become involved in any financial transactions related to listings.
Site Operations
While every effort will be made to provide a full and complete service on a 24/365 basis, Equinext make no guarantees to that nature. We are not responsible for, not accept any liability for, the actions of our hosting company or the actions of any third party affecting delivery of the site.
While we will endeavour to provide warnings of any required site 'down time' we make no guarantees of such warnings and reserve the right to restrict access to the whole or any part of the site at any time for any period.
Equinext reserves the right to suspend the display of, or delete, any advertisement, photograph, forum or blog posting without warning or explanation.
Equinext reserves the right to suspend or delete the account of any user, or ban any IP address from access to the site wihout warning.
Distances listed in association with advertisements are approximations only and Equinext accepts no liability for the actual distances required to visit the location of an advertised product or service.
If you are unable to accept the above terms, please refrain from using the site.
